Hardware Limited Warranty Policy

Legal documents can be long and complex, so we’ve added a short, simple breakdown to make things easier. Look for the highlighted sections - they’re here to explain the key points in plain language. Just a quick note: these summaries aren’t legally binding. They’re simply here to help you better understand the official terms.

All capitalized terms not defined in this Policy have the same meanings as in OBDeleven Terms.

1.    Consumer Rights
 
You might have extra rights under your local consumer protection laws (like the EU’s two-year warranty rules). This warranty doesn’t take those rights away - it’s on top of them. Some places don’t allow certain limits, so some parts of this warranty might not apply to you.

1.1.    For consumers covered by applicable consumer protection laws or regulations in their country of purchase or, if different, their country of residence, the benefits conferred by this limited warranty are in addition to all rights and remedies provided by such laws.

1.2.    Some countries, states, or provinces do not allow the exclusion or limitation of incidental or consequential damages, or limitations on the duration of implied warranties. Accordingly, the limitations and exclusions set forth in this section may not apply to you.

1.3.    This limited warranty provides specific legal rights, and you may also have other rights that vary depending on your jurisdiction.

2.    Limited Warranty Coverage
 
New OBDeleven hardware is covered for 2 years, refurbished ones for at least 90 days. If your device fails under normal use during that time, we’ll repair it, replace it or refund your money - our choice. Repairs and replacements are free, but you pay for shipping. Anything we replace becomes our property.

2.1.    OBDeleven provides this limited warranty of Hardware. Hardware devices are warranted to be free from defects in materials or workmanship under normal use:

2.1.1.    New Hardware: 2 years from the date of purchase by the original end-user purchaser.

2.1.2.    Refurbished Hardware: 90 days after shipment by OBDeleven, or the remainder of the new Hardware Warranty Period, whichever is longer (collectively, the Warranty Period).

2.2.    During the Warranty Period, OBDeleven may, at its sole discretion and as exclusive remedy, choose to:

2.2.1.    repair the Hardware using new or refurbished parts;

2.2.2.    replace the Hardware with reasonably equivalent new or refurbished Hardware; or

2.2.3.    refund the actual purchase price of the Hardware, less any rebates or discounts.

2.3.    Repairs or replacements under this warranty will be made at no cost for parts or labor, but you are responsible for all shipping and handling charges. All replaced Hardware and parts become the property of OBDeleven.

3.    Warranty Limitations
 
 
This warranty only applies if you bought your hardware from us or an authorized reseller. It doesn’t cover cosmetic damage, consumable parts like batteries (unless defective), misuse, accidents, water damage, unauthorized repairs, modified hardware or beta/demo units. We can reject claims if the product was obtained or used illegally.

3.1.    This limited warranty applies only to Hardware purchased from OBDeleven or an OBDeleven Authorized Reseller.

3.2.    This limited warranty does not cover:

3.2.1.    cosmetic damage (scratches, nicks, dents);

3.2.2.    consumable parts such as batteries, unless failure occurs due to a defect in materials or workmanship;

3.2.3.    damage caused by abnormal physical or electrical stress, negligence, accidents, abuse, misuse, water, flood, fire, or acts of nature;

3.2.4.    damage from service or repair performed by non-authorized personnel;

3.2.5.    Hardware modified or altered without written consent from OBDeleven;

3.2.6.    Hardware not installed, operated, or maintained according to OBDeleven instructions or Terms of Service;

3.2.7.    Hardware supplied for beta, evaluation, testing, or demonstration purposes without purchase or license fee.

3.3.    OBDeleven reserves the right to refuse warranty claims for Hardware obtained or used in violation of applicable laws.

4.    Software and Services Disclaimer
 
The software that comes with your device and any related services are provided “as is” - no promises they’ll work perfectly, be available forever or protect against every security threat. We don’t guarantee uninterrupted operation or specific results.

4.1.    To the maximum extent permitted by law, all software and services provided with the Hardware, whether factory-installed or downloadable, are provided “as is” without warranty of any kind.

4.2.    OBDeleven does not warrant that the Hardware, Software, or Services will operate uninterrupted, error-free, or result in any specific efficiency or savings.

4.3.    OBDeleven does not guarantee that Hardware, Software, or Services, or any equipment, system, or network used with them, will be secure or free from vulnerability to intrusion or attack.

4.4.    The limited warranty does not guarantee the continued availability of any third-party service upon which the Hardware may depend.

5.    Limitation of Liability
 
We limit all implied warranties to the length of the warranty period. We aren’t responsible for lost data, profits, third-party services, or vehicle damage caused by using our hardware or software. Our total liability is capped at what you paid for the hardware. If you’re in the EU or EEA, we still follow your legal consumer protections.

5.1.    To the extent permitted by law, all implied warranties (including merchantability, satisfactory quality, or fitness for a particular purpose) are limited to the duration of the Warranty Period.

5.2.    OBDeleven is not liable for:

5.2.1.    lost or damaged data (including data erased during repair/replacement);

5.2.2.    lost revenue or profit;

5.2.3.    loss of ability to use third-party products, software, or services;

5.2.4.    vehicle damage from use of Hardware, Software, or Services;

5.2.5.    special, indirect, consequential, incidental, or punitive damages, whether under contract, tort, or other legal theory, even if OBDeleven was advised of the possibility of such damages.

5.3.    OBDeleven does not guarantee accurate or error-free vehicle error detection. Users should seek professional assistance for vehicle maintenance, diagnostics, or repairs.

5.4.    To the maximum extent permitted by law, OBDeleven’s total liability is limited to the amount paid by you for the Hardware.

5.5.    For residents of the EU, Norway, Iceland, or Liechtenstein, references to “special, indirect, consequential or incidental losses” include losses that:

5.5.1.    were not reasonably foreseeable by both parties;

5.5.2.    were known to you but not OBDeleven; or

5.5.3.    were reasonably foreseeable but could have been prevented by you, including data loss from viruses or malware.

6.    Warranty Enforcement
 
Only the written terms here count - no employee, agent, or reseller can change this warranty for you. If one part of this policy is invalid, the rest still applies.

6.1.    No OBDeleven employee, agent, or reseller is authorized to modify, extend, or add to this limited warranty. Any such modifications are void.

6.2.    If any portion of this limited warranty is found invalid or unenforceable, the remaining provisions remain in full force and effect.

7.    Obtaining Warranty Service
 
If you need service, contact us via our help platform. You’ll need to securely package your hardware, include proof of purchase, and cover shipping and taxes. If we confirm the defect, we’ll repair, replace or refund your device. If we can’t reproduce the problem or verify the purchase, we’ll reject the claim. We don’t ship replacements outside the original country of purchase.


7.1.    To request warranty service, contact OBDeleven via the help platform. Instructions will be provided for submitting your claim.

7.2.    You are responsible for securely packaging the Hardware and including requested documentation (e.g., invoice). You are also responsible for shipping, handling, and any applicable customs duties, VAT, or other taxes; these costs are non-reimbursable.

7.3.    Hardware for which OBDeleven cannot reproduce the claimed defect or for which purchase cannot be verified will be rejected.

7.4.    Defective Hardware covered by this warranty will be repaired, replaced, or refunded at OBDeleven’s discretion, without additional charge.

7.5.    OBDeleven does not ship replacement Hardware internationally outside the country of original purchase. Repairs or replacements not covered by this warranty are subject to OBDeleven’s then-current rates.

8.    Consumer Complaint Rights
 
If you’re in the EU, Norway, Iceland, or Liechtenstein and you disagree with our decision, you can file a complaint with your local consumer protection authority or use the EU’s online dispute resolution platform. People outside these regions should contact their local consumer agency.

8.1.    Residents of the European Union, Norway, Iceland, or Liechtenstein who disagree with a warranty claim decision may submit a complaint to the State Consumer Rights Protection Authority:

8.2.    Alternatively, EU residents may use the online consumer dispute resolution platform.

Residents outside these countries may contact their national consumer protection authority for guidance.
